دراسة المعاملات المالية في الإسلام دراسة فقهية هي من أهم مواضيع فقه
المعاملات المعاصرة، وذلك لما استجد من وسائل حديثة ولم تناقش عند فقهاء سلف الأمة . وهدفت هذه الدراسة إلى محاولة التوصل إلى صورة متكاملة عن مفهوم
وطبيعة المعاملات المالية في الشريعة الإسلامية وت . عتمد هذه دراسته على منهجين
المنه ج النظري و المنهج التحليلي .
ومن النتائج أن المعاملات المالية مفهوم شامل في كل المجالات. تَتَميز المعاملات
المالية في الشريعة الإسلامية بخصائص فريدة، منها، أنَّها ربانية المصدر و، أنَّها
مبنيةٌ على العدل الكامل و، أنها مبنية على مراعاة الأخلاق الفاضلة. يرتبط تطبيق
أحكام المعاملات الشرعية بمراقبة االله تعالى وخشيته. المعاملات المالية لها ثلاثة
أحكام هي: العدل، الفضل، الظلم .
ومن التوصيات الإلمام بكل ما يتعلق بأنواع المعاملات المالية والتعامل معها
بصورة جيدة، يجب الالتزام بالضوابط المقررة لتفادي الوقوع في المحرمات،
الالتزام بحكم الشريعة الإسلامية في المعاملات المالية وتجنب الربا والمحرمات
لتفادي المشاكل.

ABSTRACT

All praises are Allah’s, with his favors all righteous are
completed. Peace and blessing of Allah be with the last of his
messengers, and all his companions.
Islamic Financial Transaction is one of the significant topics with
regards to modern FiqhMua’malat, due to its many modern
issues which have not been discussed by the previous scholars.
The main objective of the study is to find out the integrated
concept and nature of financial transaction in Islamic Law. And
to answer several questions raised by people about the reality of
Islamic Financial Transaction. In addition, the study also aimed
at showing the comprehensiveness of Islamic Financial
Transaction, so that there will be no more suspicious about it.
The main result of the study are: Islamic Financial Transaction is
a comprehensive concept in all fields; Financial Transaction in Islamic Law has special qualities including divine source, it is
based on real justice, good moral, it is connected with god’s
fearing. Moreover, the Fiancial Transaction has three kind of
rules, which are; Justice, favour and injustice. The study
recommends that there is need for seeking knowledge about
anything connected with Financial Transaction and to be utilized
in a good manner. People should comply with all regulations
prescribed to avoid prohibited matters. The rules of Islamic law
with regards to financial transaction should be applied, and the
usury should be avoided to keep away from getting in to
problems.
