هذا البحث بعنوان المداراة في الفقه الإسلامي قام الباحث فيه بدراسة مصطلحالمداراة وتعريفه وتمييزه عن المصلحات القريبة منه وبيان صور المداراة في الفقه والهدف من ذلك بيان صور المداراة ومواطن استعمالاته وقد استخدم الباحث المنهج الاستقرائي التحليلي . واشتملت الدراسة على مقدمة ومبحثين وخاتمة وفهارس.

ففي المقدمة ذكر الباحث أهمية الموضوع، وأسباب اختياره، وأهدافه، ومشكلته، والدراسات السابقة ومنهج الدراسة وهيكل البحث، والمبحث الأول في التعريف بالمداراة وفيه مطلبان الأول في تعريف المداراة في اللغة والاصطلاح، والثاني في مرادفات المداراة والفرق بينهما.

والمبحث الثاني: في المداراة في الفقه الإسلامي وفيه مطلبان الأول المداراة في القرآن والسنة وآثار الصحابة وأقوال الفقهاء، والثاني صور المداراة.

وتوصل الباحث من خلال الدراسة إلى عدة نتائج منها : أن المداراة اتقاء شر العدو أو الترفق بالجاهل في التعليم بأسلوب حسن مع عدم الإقرار على الباطل أو التوصل لذلك بمعصية الله فإذا كانت إقرارا للباطل أو شابتها معصية الله كانت مداهنة. أن المداراة لها صور تستعمل فيها من أبرزها مداراة أهل الكفر وأئمة الظلم والجور ومداراة أهل الفسق ومداراة الزوجات. ويوصي الباحث طلبة العلم والباحثين بمزيد من الدراسات المتخصصة في صور المداراة وخاصة التي يحتاج لها في هذه الأزمنة كمداراة أهل الكفر وأئمة الظلم والجور.
Abstract
This research is entitled Politeness in Islamic Jurisprudence, in which
the researcher studied the term politeness, its definition and distinction
from the interests close to it, and the explanation of the images of
politeness in jurisprudence. In the introduction, the researcher
mentioned the importance of the topic, the reasons for choosing it, its
objectives, its problem, the previous studies, the study method, the structure of the research, and the first topic in the definition of
politeness: it contains two requirements, the first in defining politeness
in language and convention, and the second in the synonyms of
politeness and the difference between them. And the second topic: On
politeness in Islamic jurisprudence: It contains two requirements, the
first is politeness in the Qur’an and Sunnah, the effects of the
Companions and the sayings of scholars, and the second is images of
politeness. Through the study, the researcher reached several results,
including: that politeness is to avoid the evil of the enemy or to be
gentle with the ignorant in teaching in a good manner, while not
acknowledging falsehood or reaching that by disobeying God. The
most prominent of them is politeness with the people of disbelief and
imams of injustice and oppression, politeness with the people of
immorality and politeness with wives
